ODNR Division of Watercraft Current Legislative Proposals:

§ 1547.132. Law enforcement and public service safety zone.

(A) No person shall operate a vessel at a speed that creates a wake within one hundred feet of any stationary law enforcement vessel displaying at least one flashing, oscillating, or rotating light conforming with the requirements of 33 CFR § 88.11.

(B) No person shall operate a vessel at a speed that creates a wake within one hundred feet of any public service vessel, stationary or otherwise actively providing public service, displaying at least one flashing, oscillating, or rotating light conforming with the requirements of 33 CFR § 88.12. Public safety activities include but are not limited to escorting or patrolling special water events; traffic control; salvage; firefighting; medical assistance; assisting disabled vessels; and search and rescue.

(C) No person shall permit any vessel to be operated on the waters in this state in violation of this section.

§ 1547.14. Water skiing confined to ski zones.

(A) Except on the waters of Lake Erie, the Ohio River, Lake Erie and immediately connected harbors and anchorage facilities bays, any person who rides or attempts to ride upon one or more water skis, surfboard, or similar device, or who engages or attempts to engage in barefoot skiing, and any person who operates a vessel towing a person riding or attempting to ride on one or more water skis, surfboard, or similar device, or engaging or attempting to engage in barefoot skiing, shall confine that activity to the water area within a designated ski zone on all bodies of water on which a ski zone has been established.

(B) On all bodies of water designated as "open zone," that is, having a combined speed and ski zone, the activities described in division (A) of this section shall be confined to the open zone except when traveling at idle speed in a designated no wake zone and the activity is not being conducted in any of the following areas:

(1) Within 300’ of a gas dock, marina, launch ramp, or harbor entrance,

(2) Within a designated anchorage area, swim zone, boat swim zone, or boat camping area,

(3) Under any bridge or within 300’ of a bridge underpass,

(4) Any area marked as no ski zone.

(C) No person shall operate or permit to be operated any vessel on the waters in this state in violation of this section.

§ 1547.24. Children under 10 must wear appropriate size personal flotation device.  No person shall operate or permit to be operated any vessel under eighteen feet in length while there is present in the vessel any person under ten years of age, not wearing a coast guard approved type one, two, or three, or five personal flotation device in good and serviceable condition of appropriate size securely attached to the person under ten years of age.

§ 1548.05 Manufacturer’s or importer’s certificate. No manufacturer, importer, dealer, or other person shall sell or otherwise dispose of a new watercraft or outboard motor to a dealer to be used by the dealer for purposes of display and resale without delivering to the dealer a manufacturer's or importer's certificate executed in accordance with this section and with such assignments on it as are necessary to show title in the name of the purchaser. No dealer shall purchase or acquire a new watercraft or outboard motor without obtaining from the seller the manufacturer's or importer's certificate.  A manufacturer's or importer's certificate of the origin of a watercraft or outboard motor shall contain the following information in such form and together with such further information as the chief of the division of watercraft may require:

(A) Description of the watercraft, including the make, model year or year of manufacture, length, series or model, if any, body type, hull identification number or serial number, and make, manufacturer's serial number, and horsepower of any inboard motor or motors; or description of the outboard motor, including the make, model year or year of manufacture, series or model, if any, manufacturer's serial number, and horsepower;

(B) Certification of the date of transfer of the watercraft or outboard motor to a distributor or dealer or other transferee, and the name and address of the transferee;

(C) Certification that this was the first transfer of the new watercraft or outboard motor in ordinary trade and commerce;

(D) Signature and address of a representative of the transferor.

An assignment of a manufacturer's or importer's certificate before a notary public or other officer empowered to administer oaths shall be printed on the reverse side of the manufacturer's or importer's certificate in the form to be prescribed by the chief. The assignment form shall include the name and address of the transferee, a certification that the watercraft or outboard motor is new, and a warranty that the title at the time of delivery is subject only to such liens and encumbrances as are set forth and described in full in the assignment.

§ 1547.072 Failure to Control.

(A) No person shall operate a vessel on the waters in this state without being in reasonable control of the vessel.

(B) Whoever violates this section is guilty of operating a vessel without being in control of it.

HB 225 CONCEALED HANDGUNS (Adams) To authorize a person to carry a concealed handgun without obtaining a license to the same extent as if the person had obtained such a license if the person qualifies for a concealed carry license and is legally permitted to purchase a handgun; to remove the requirements that a concealed carry licensee must be carrying the license in order to carry a concealed handgun, must inform approaching law enforcement officers that the person has a license and is carrying the handgun when the person is carrying a concealed handgun, and must submit a new or renewed competency certification when renewing the license; to eliminate as premises in which a concealed carry licensee may not carry a concealed handgun public or private institutions of higher education, places of worship, day-care centers and homes, and government buildings other than schools, courthouses, law enforcement offices, and correctional facilities; to replace the prohibitions that apply only to a concealed carry licensee who is carrying a handgun in a motor vehicle with a prohibition against a licensee who is in a motor vehicle that is stopped by a law enforcement officer knowingly menacing or threatening an officer with a loaded handgun or knowingly pointing a loaded handgun at an officer; to remove the "in plain sight or secure encasement" criterion that a concealed carry licensee must satisfy to legally possess a handgun in a motor vehicle; to provide a self-defense exemption from the prohibitions against discharging a firearm in or on a vessel or motor vehicle;

to repeal the "journalist exception" to the provision that otherwise makes confidential the records a sheriff possesses regarding concealed handgun licenses and applications for such licenses; and to amend the version of section 2923.129 of the Revised Code that is scheduled to take effect September 29, 2007, to continue the provisions of this act on and after that effective date.

SB 113 TRAILER TITLES (Boccieri) To apply the motor vehicle certificate of title law to trailers and semitrailers that weigh 4,000 pounds or less and are not farm trailers. Am. 4505.01 and 4505.063
