First Quarter Report, 2008:

 

The 2008 session of the Virginia Legislature had one boating safety bill introduced.  This was H.B. 1250.  The bill, in accordance with federal guidelines, called for a Child PFD Wear Requirement for 12 years age.  The bill narrowly passed the House Subcommittee and the full Committee on Agriculture and Natural Resources on 4 and 6 February with an amendment to fix the boat size affected at 21 feet and under.  Unfortunately, the full House floor vote approved a motion to refer it to Appropriations on 8 February by a 47-52 vote along party lines; thereby effectively killing the bill in the 2008 session.  This was the 8th time this proposal failed to pass the Virginia Legislature.  On 1 April, the Virginia Safe Boating Coalition will meet and consider reintroducing a similar bill in 2009.

Fourth Quarter Report, 2007:

Development of implementation procedures for the enacted 2007 Boating Education legislation are almost complete after input and review by the U.S. Coast Guard Auxiliary, the U.S. Power Squadron, state marine industries, and others.  The DGIF (Virginia Department of Game and Inland Fisheries) plans to present them to the House & Senate Committees in January.  It is anticipated that implementation will begin as planned on 1 July.

The Virginia Safe Boating Alliance, who was instrumental in obtaining the passage of the Boating Education legislation, in 2007, has recently agreed to consider legislative actions to promote the submission and passage of a Child Life Jacket Bill in 2009.  It is expected that the Alliance will meet this coming spring to develop an action plan.

Third Quarter Report, 2007:

 

The DGIF, with assistance from the Virginia Safe Boating Coalition, is developing procedures to implement the new boating education law beginning 1 July 2008.  There is no expected boating safety legislation to be introduced in 2008.

 

Second Quarter Report, 2007:

 

The Virginia Legislature is not in session and will begin its next session in January of 2008.  Introduction of recreational boating legislation at that time is not currently anticipated.  Work does, however, continue on developing the implementation procedures regarding the recently passed boating education bill.

 

First Quarter Report, 2007:

Boating education legislation has been signed by the governor.  There are no further boating safety legislative initiatives this year.

The 2007 General Assembly passed legislation that will require most boat operators to complete an approved safety education course.

 

This new requirement will begin to be phased-in on July 1, 2009, and will complete phase-in on July 1, 2016.

1. Personal watercraft (PWC) operators age 20 or younger must meet the requirement by July 1, 2009.  PWC operators who are age 14 and 15 already are required to take a course.

2. PWC operators 35 or younger, July 1, 2010.

3. PWC operators 50 or younger, July 1, 2011.

4. All PWC operators, July 1, 2012.

5. Motorboat operators age 20 or younger, July 1, 2011.

6. Motorboat operators 30 and younger, July 1, 2012.

7. Motorboat operators 40 or younger, July 1, 2013.

8. Motorboat operators 45 or younger, July 1, 2014.

9. Motorboat operators 50 and younger, July 1, 2015

10. All motorboat operators, all ages, July 1, 2016.

Exemptions:  (1) commercial fishermen and those working under their supervision, (2) maritime personnel who are licensed by the U.S. Coast Guard or Canadian government, (3) operators who have a rental or lease agreement from a boating business, (4) holders of a temporary, 90-day operator’s certificate which is issued as part of a transfer of ownership when a new or used boat is sold.
